Terms of Service

These Terms of Service ("Terms") govern your use of the IRIS IEP platform ("the System") operated by IRIS IEP ("we," "our"). By accessing or using the System, you agree to be bound by these Terms.

1. Acceptable Use

You agree to use the System only for its intended purpose: managing Individualized Education Programs for students in Washington State. You may not:

  • Access or attempt to access data for students or districts you are not authorized to view
  • Share your login credentials with any other person
  • Use the System to store information unrelated to IEP management
  • Attempt to reverse-engineer, decompile, or disassemble any part of the System
  • Use automated tools (bots, scrapers) to access the System without written authorization
  • Transmit malicious code, viruses, or any material that could harm the System or its users

2. Account Responsibilities

Accounts are provisioned by district administrators. You are responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account. You must notify your district administrator immediately if you suspect unauthorized access to your account.

3. Data Ownership

Districts own their data. All student education records, IEP documents, and district-specific data entered into the System remain the property of the respective school district. We do not claim ownership of any education records or district data. Upon termination of service, districts may request a full export of their data in a standard format.

4. Service Availability

We strive to maintain high availability of the System but do not guarantee uninterrupted access. The System may be temporarily unavailable for scheduled maintenance, updates, or due to circumstances beyond our control. We will provide reasonable advance notice of planned downtime to district administrators.

5. Compliance Obligations

The System is designed to support compliance with FERPA, IDEA, Section 504, and Washington State special education regulations. However, ultimate responsibility for regulatory compliance rests with the school district. The System is a tool to support — not replace — the professional judgment of educators, administrators, and IEP teams.

6. Limitation of Liability

To the maximum extent permitted by law, IRIS IEP shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of data, loss of revenue, or compliance penalties, arising out of or relating to your use of the System. Our total liability for any claims arising under these Terms shall not exceed the amount paid by the district for the System in the twelve months preceding the claim.

7. Indemnification

You agree to indemnify and hold harmless IRIS IEP from any claims, damages, or expenses arising from your violation of these Terms or misuse of the System.

8. Termination

We may suspend or terminate access to the System for any user who violates these Terms. District administrators may deactivate user accounts at any time. A district may terminate its use of the System by providing written notice. Upon termination, we will provide the district with a data export and securely delete their data within 90 days, unless retention is required by law.

9. Changes to These Terms

We may update these Terms from time to time. Material changes will be communicated to district administrators at least 30 days in advance. Continued use of the System after changes take effect constitutes acceptance of the revised Terms.

10. Governing Law

These Terms are governed by and construed in accordance with the laws of the State of Washington, without regard to its conflict-of-law principles. Any disputes arising under these Terms shall be resolved in the state or federal courts located in Washington State.
